d\u00e9finition officielle, l\u2019<strong>astreinte<\/strong> correspond \u00e0 une p\u00e9riode (une heure, une journ\u00e9e ou une nuit) pendant laquelle le salari\u00e9 doit \u00eatre en mesure d\u2019intervenir au service de l\u2019entreprise en cas de besoin.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Il est important de pr\u00e9ciser que :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Le salari\u00e9 n\u2019est pas oblig\u00e9 d\u2019\u00eatre sur son lieu de travail<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Le salari\u00e9 n\u2019a pas \u00e0 \u00eatre \u00e0 la disposition permanente de l\u2019employeur<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La disponibilit\u00e9 du travailleur n\u2019est pas n\u00e9cessairement imm\u00e9diate<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">Quelle est la diff\u00e9rence entre une astreinte et une permanence\u2009?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Souvent confondus, <strong>garde et astreinte<\/strong> sont pourtant bien diff\u00e9rents. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Si ces deux termes correspondent \u00e0 des am\u00e9nagements du <\/span><a href=\"https:\/\/factorial.fr\/blog\/temps-de-travail\/\"><span style=\"font-weight: 400;\">temps de travail<\/span><\/a><span style=\"font-weight: 400;\"> destin\u00e9s \u00e0 assurer un service continu, ils diff\u00e8rent profond\u00e9ment, sur plusieurs points\u00a0:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La garde, ou permanence, implique d\u2019\u00eatre sur son lieu de travail.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">La permanence est consid\u00e9r\u00e9e comme du temps de travail.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Le planning des permanences doit \u00eatre communiqu\u00e9 au minimum un mois \u00e0 l\u2019avance, contre seulement 15\u00a0jours pour les astreintes.<\/span><\/li>\n<\/ul>\n<h2><span style=\"font-weight: 400;\">Mise en place dans l\u2019entreprise<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Elle peut se faire de 3 mani\u00e8res, par :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Une convention collective ou un accord de branche<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Un accord d\u2019entreprise ou d\u2019\u00e9tablissement<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">L\u2019employeur, avec l\u2019accord du salari\u00e9, et apr\u00e8s avoir obtenu l\u2019avis favorable de l\u2019inspection du travail et du comit\u00e9 d\u2019entreprise ou des d\u00e9l\u00e9gu\u00e9s du personnel<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Le d\u00e9lai d\u2019information des p\u00e9riodes d\u2019astreinte est d\u00e9fini par l\u2019accord, et se doit d\u2019\u00eatre \u00ab\u2009raisonnable\u2009\u00bb, selon les termes du code du travail. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">En l\u2019absence de d\u00e9lai pr\u00e9vu dans la convention, celui-ci est de 15\u00a0jours minimum.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Qui peut \u00eatre d\u2019astreinte\u2009?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Tout salari\u00e9 peut potentiellement l&rsquo;\u00eatre, en fonction des accords collectifs.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Comment la calculer ?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Les <strong>heures d\u2019astreinte<\/strong> doivent \u00eatre planifi\u00e9es et comptabilis\u00e9es. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">En fin de mois, il est obligatoire de remettre un document au salari\u00e9 avec le r\u00e9capitulatif des p\u00e9riodes concern\u00e9es, et leur contrepartie.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En revanche, les interventions durant cette p\u00e9riode sont style=\"font-weight: 400;\">Les astreintes donnent lieu obligatoirement \u00e0 une compensation, d\u00e9finie par la convention collective ou l\u2019accord d\u2019entreprise.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Comment sont pay\u00e9es les heures d\u2019astreinte\u2009?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Elles peuvent \u00eatre r\u00e9mun\u00e9r\u00e9es de deux mani\u00e8res :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Par une contrepartie financi\u00e8re<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sous forme de repos additionnel<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-weight: 400;\">La r\u00e9mun\u00e9ration des interventions pendant l\u2019astreinte<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Ces interventions sont consid\u00e9r\u00e9es comme du temps de travail, et sont donc r\u00e9mun\u00e9r\u00e9es comme tel.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">De plus, le temps de trajet jusqu\u2019au lieu de l\u2019intervention est lui aussi consid\u00e9r\u00e9 comme du temps de travail\u00a0: les heures de d\u00e9placement doivent donc aussi \u00eatre r\u00e9mun\u00e9r\u00e9es.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Astreinte et temps de travail<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">L\u2019astreinte ne s\u2019effectuant pas sur le lieu de travail, elle est consid\u00e9r\u00e9e comme faisant partie du repos quotidien de 11\u00a0heures cons\u00e9cutives. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Si elle a lieu le week end, elles sont incluses dans les 35 heures cons\u00e9cutives de repos hebdomadaires obligatoires.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En revanche, le <\/span><a href=\"https:\/\/factorial.fr\/blog\/calcul-temps-travail\/\"><span style=\"font-weight: 400;\">calcul du temps de repos<\/span><\/a><span style=\"font-weight: 400;\"> se complique en cas d\u2019intervention. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Celle-ci \u00e9tant consid\u00e9r\u00e9e comme du travail, le salari\u00e9 doit pouvoir ensuite jouir de son repos quotidien ou hebdomadaire l\u00e9gal, ce qui peut amener \u00e0 des am\u00e9nagements de son horaire.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Astreinte et heures suppl\u00e9mentaires<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Les astreintes ne sont pas consid\u00e9r\u00e9es comme du temps de travail et ne donnent donc pas droit aux <a href=\"https:\/\/factorial.fr\/blog\/heures-supplementaires\/\">heures suppl\u00e9mentaires<\/a>. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">En revanche, les \u00e9ventuelles interventions doivent bel et bien \u00eatre prises en compte pour le calcul des heures suppl\u00e9mentaires.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Indemnisation et fiscalit\u00e9<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">La compensation financi\u00e8re des astreintes est soumise aux cotisations sociales. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Les primes d\u2019astreinte sont donc comptabilis\u00e9es de la m\u00eame mani\u00e8re que n\u2019importe quel autre bonus de salaire.<\/span><\/p>\n<h2><b>FAQ<\/b><\/h2>\n<h3><span style=\"font-weight: 400;\">Est-ce qu\u2019une astreinte est obligatoire\u2009?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Elle est obligatoire pour le salari\u00e9 dans deux cas bien pr\u00e9cis :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Elle est pr\u00e9vue par la convention collective<\/span><\/li>\n<li d\u00e9finitive\u2009?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Les termes d\u2019<strong>astreinte provisoire<\/strong> et d\u2019<strong>astreinte d\u00e9finitive<\/strong> ne sont pas li\u00e9s au code du travail, mais \u00e0 la justice. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ce sont des termes l\u00e9gaux qui ne s\u2019appliquent pas au monde professionnel.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Un accident du travail pendant une astreinte\u2009est-il pris en compte ?<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Un
