Il cumule des cong\u00e9s pay\u00e9s d\u00e8s son premier jour de travail.<\/p>\n<p>Selon l\u2019article L3141-1 du<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000033020838\/\"> Code du travail<\/a>, tout salari\u00e9 a droit \u00e0 des cong\u00e9s pay\u00e9s, qu\u2019ils soient en contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e, \u00e0 dur\u00e9e ind\u00e9termin\u00e9e, en contrat de professionnalisation, en contrat d\u2019apprentissage, \u00e0 temps partiel ou \u00e0 temps plein.<\/p>\n<p>Pour comptabiliser le nombre de cong\u00e9s, le calcul peut s\u2019effectuer en jours ouvr\u00e9s comme en <a href=\"https:\/\/factorial.fr\/blog\/jours-ouvres-jours-ouvrables\/\">jours ouvrables<\/a>.<\/p>\n<p>Si l\u2019on fait un <a href=\"https:\/\/factorial.fr\/blog\/jours-ouvrables\/\">calcul en jours ouvrables<\/a>, un salari\u00e9 acquiert 2,5 jours (6 jours sur 7, le dimanche exclu) par mois de travail effectif. Ce qui donne un total de 30 jours de cong\u00e9 annuel sur la p\u00e9riode de r\u00e9f\u00e9rence.<\/p>\n<p>En jour ouvr\u00e9s, un employ\u00e9 acquiert 2,0833 jours par mois, soit 25 jours par an.<\/p>\n<p>L\u2019employeur peut permettre de poser des cong\u00e9s suppl\u00e9mentaires mais selon des conditions pr\u00e9cises, ce sont les <a href=\"https:\/\/factorial.fr\/blog\/jours-fractionnement\/\">jours de fractionnement<\/a>.<\/p>\n<h2><a name=\"indmnite\"><\/a>Qu\u2019est-ce que l&rsquo;indemnit\u00e9 de cong\u00e9s pay\u00e9s ?<\/h2>\n<p>L\u2019indemnit\u00e9 de <a href=\"https:\/\/factorial.fr\/blog\/conges-payes\/\">cong\u00e9s pay\u00e9s<\/a> est due \u00e0 un employ\u00e9 qui prend un cong\u00e9 afin qu\u2019il ne subisse pas de perte de salaire quand il est au repos.<\/p>\n<p>Tous les salari\u00e9s, quel que soit leur contrat, b\u00e9n\u00e9ficient de cong\u00e9s pay\u00e9s et donc de cette indemnit\u00e9 (CDD, CDI, contrat d&rsquo;apprentissage&#8230;).<\/p>\n<p>En fonction des conventions collectives des entreprises, d\u2019autres \u00e9l\u00e9ments de salaire peuvent \u00eatre pris en compte. l\u2019indemnit\u00e9 de cong\u00e9s pay\u00e9s <\/b><span style=\"font-weight: 400;\">: la r\u00e8gle du 1\/10 et le maintien du salaire.<\/span><\/p>\n<h3><b>Calcul indemnit\u00e9 cong\u00e9s pay\u00e9s : la r\u00e8gle du 1\/10<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">La r\u00e8gle du 1\/10 est calcul\u00e9e \u00e0 partir de la r\u00e9mun\u00e9ration brute que le salari\u00e9 a per\u00e7ue pendant la p\u00e9riode de r\u00e9f\u00e9rence.<\/span><\/p>\n<h4><b>Qu&rsquo;est-ce que le 10\u00e8me CP ?<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">Le salari\u00e9 re\u00e7oit une indemnisation de ses cong\u00e9s pay\u00e9s sur la base d&rsquo;un dixi\u00e8me de sa r\u00e9mun\u00e9ration annuelle brute correspondant aux cong\u00e9s pay\u00e9s acquis du 1<\/span><span style=\"font-weight: 400;\">er<\/span><span style=\"font-weight: 400;\"> juin de l\u2019ann\u00e9e N au 31 mai de l\u2019ann\u00e9e N + 1.<\/span><\/p>\n<h4><b>Comment calculer le 10\u00e8me CP ?<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">La m\u00e9thode consiste \u00e0 diviser 1\/10 de la base de <a href=\"https:\/\/factorial.fr\/blog\/calcul-conges-payes\/\">calcul des cong\u00e9s pay\u00e9s<\/a> divis\u00e9 par le nombre de cong\u00e9s pay\u00e9s que le salari\u00e9 a acquis sur la p\u00e9riode de r\u00e9f\u00e9rence, dans le but de d\u00e9terminer un taux journalier.<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">R\u00e9mun\u00e9ration annuelle brute x 1\/10<\/span><\/i><i><span style=\"font-weight: 400;\">\u00e8me<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400;\">Le r\u00e9sultat sera alors multipli\u00e9 par le nombre de jours de cong\u00e9s pris ou, dans le cas d\u2019une indemnit\u00e9 compensatrice de cong\u00e9s pay\u00e9s, \u00e0 solder.<\/span><\/p>\n<p>Dans le calcul de l\u2019indemnit\u00e9 de cong\u00e9s pay\u00e9s, pensez \u00e0 ajouter :<\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prime d\u2019anciennet\u00e9<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Salaire de base<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">R\u00e9mun\u00e9ration des heures suppl\u00e9mentaires<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Commissions pour le cas des commerciaux<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Gratifications et les primes qui sont affect\u00e9es par la prise de cong\u00e9s pay\u00e9s\u00a0(primes d\u2019objectif, par exemple)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Indemnit\u00e9s qui sont attribu\u00e9es lors des p\u00e9riodes qui peuvent \u00eatre assimil\u00e9es \u00e0 du travail effectif (compl\u00e9ment de salaire \u00e0 la suite d\u2019un accident de travail, indemnit\u00e9 de cong\u00e9 pay\u00e9 de l\u2019ann\u00e9e pr\u00e9c\u00e9dente, etc.).<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\"><strong>Exemple :<\/strong> <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pour un salari\u00e9 qui per\u00e7oit 1 600 euros bruts par mois pour un travail effectif de 152 heures pendant cette p\u00e9riode, il re\u00e7oit 19 500 euros, toutes primes confondues, sur la p\u00e9riode de r\u00e9f\u00e9rence. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">En appliquant la r\u00e8gle du 1\/10\u00e8me, le calcul ressemblera \u00e0 celui-ci :<\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">19 500 euros x 1 \/ 10\u00e8me = 1 950 euros<\/span><\/i><span style=\"font-weight: 400;\"> (pour 30 jours de cong\u00e9s, ce qui donne apr\u00e8s calcul 65 euros par jour)<\/span><\/p>\n<h3>Calcul Indemnit\u00e9 cong\u00e9s pay\u00e9s : la r\u00e8gle du maintien de salaire<\/h3>\n<p>Pour le calcul de l\u2019indemnit\u00e9\u00a0de cong\u00e9s pay\u00e9s avec la m\u00e9thode du maintien de salaire,\u00a0la fa\u00e7on de proc\u00e9der est identique \u00e0 celle des absences.<\/p>\n<p><span style=\"font-weight: 400;\">Pour ce mode de calcul, il faudra prendre en compte les param\u00e8tres suivants :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">le salaire brut du salari\u00e9 pendant la p\u00e9riode qui pr\u00e9c\u00e8de le cong\u00e9, \u00e0 partir des \u00e9l\u00e9ments qui sont retenus pour les indemnit\u00e9s calcul\u00e9es \u00e0 partir de la m\u00e9thode du 1\/10 que l\u2019on a \u00e9num\u00e9r\u00e9e ci-dessus ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">les heures de travail qui auraient \u00e9t\u00e9 effectu\u00e9es par le salari\u00e9 s\u2019il n\u2019avait pas \u00e9t\u00e9 en cong\u00e9 (heures
