Elle permet notamment la transmission des donn\u00e9es aux organismes sociaux comme l&rsquo;<strong>Urssaf<\/strong>, le calcul des cotisations sociales, l&rsquo;\u00e9tablissement des droits sociaux des salari\u00e9s (s\u00e9curit\u00e9 sociale, retraite, etc.) et la constitution des listes \u00e9lectorales pour les conseils de prud&rsquo;hommes.<\/p>\n<h2 data-pm-slice=\"1 3 []\">Qui est concern\u00e9 par la DADS ?<\/h2>\n<p>La DADS doit \u00eatre remplie par tous les employeurs dont le personnel rel\u00e8ve du r\u00e9gime g\u00e9n\u00e9ral de la s\u00e9curit\u00e9 sociale, incluant entre autres les employeurs qui :<\/p>\n<ul data-spread=\"false\">\n<li>Effectuent d\u00e9j\u00e0 la <strong>DSN<\/strong> (D\u00e9claration Sociale Nominative) mais emploient des personnes hors p\u00e9rim\u00e8tre DSN<\/li>\n<li>Ont un \u00e9tablissement soumis \u00e0 la DSN mais n\u2019ont pas pu transmettre les donn\u00e9es des organismes compl\u00e9mentaires dans la DSN.<\/li>\n<\/ul>\n<h2>Qui est exon\u00e9r\u00e9 de la DADS ?<\/h2>\n<p>Certains employeurs sont dispens\u00e9s de cette d\u00e9claration, notamment ceux qui r\u00e9mun\u00e8rent leurs salari\u00e9s sous les contrats suivants :<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul data-spread=\"false\">\n<li>le<strong> titre emploi service entreprise (Tese)<\/strong><\/li>\n<li>le <strong>ch\u00e8que emploi associatif (CEA)<\/strong><\/li>\n<li>le <strong>titre simplifi\u00e9 (CESU)<\/strong> pour les particuliers employant un salari\u00e9 \u00e0 domicile.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2 data-pm-slice=\"1 1 []\">Que doit contenir la DADS ?<\/h2>\n<p>La d\u00e9claration DADS ou DADS-U doit comporter les informations relatives \u00e0 l\u2019employeur et aux salari\u00e9s, \u00e0 savoir :<\/p>\n<ul data-spread=\"false\" data-pm-slice=\"3 3 []\">\n<li>l\u2019identification de l&#8217;employeur et du salari\u00e9<\/li>\n<li>l\u2019emploi occup\u00e9 (qualification et nature de l\u2019emploi)<\/li>\n<li>le type de contrat de travail (CDI, CDD, temps partiel, temps complet)<\/li>\n<li>la p\u00e9riode d&#8217;emploi<\/li>\n<li>les dates de d\u00e9but et de fin de p\u00e9riode de paie<\/li>\n<li>le nombre d&rsquo;heures salari\u00e9es<\/li>\n<li>la condition d&#8217;emploi (temps complet, temps partiel)<\/li>\n<li>les r\u00e9mun\u00e9rations per\u00e7ues au cours de l&rsquo;ann\u00e9e pr\u00e9c\u00e9dente<\/li>\n<li>les cotisations sociales (et leur assiette) servant \u00e0 l&rsquo;ouverture des droits en mati\u00e8re d&rsquo;assurance vieillesse et d&rsquo;assurance maladie.<\/li>\n<\/ul>\n<p>L\u2019employeur est \u00e9galement tenu de mentionner au sein de la DADS le motif du d\u00e9p\u00f4t :<\/p>\n<ul data-spread=\"false\">\n<li>employeur remplissant la DSN ayant des populations exclues du p\u00e9rim\u00e8tre DSN<\/li>\n<li>employeur non soumis \u00e0 l&rsquo;obligation de remplir la DSN<\/li>\n<li>employeur n&rsquo;ayant pas transmis les donn\u00e9es des organismes compl\u00e9mentaires dans la DSN.<\/li>\n<\/ul>\n<h2 data-pm-slice=\"1 1 []\">Comment remplir la DADS ?<\/h2>\n<p>La DADS peut \u00eatre soumise selon deux modes :<\/p>\n<ol start=\"1\" data-spread=\"false\">\n<li><strong>DADS-U<\/strong> (automatis\u00e9e) : d\u00e9claration informatis\u00e9e int\u00e9gr\u00e9e aux syst\u00e8mes de gestion RH<\/li>\n<li><strong>DADSNET<\/strong> (manuelle) : d\u00e9claration \u00e0 remplir en ligne via les plateformes d\u00e9di\u00e9es.<\/li>\n<\/ol>\n<p>Les employeurs doivent veiller \u00e0 la pr\u00e9cision des informations d\u00e9clar\u00e9es afin d&rsquo;\u00e9viter tout retard ou erreur pouvant entra\u00eener des sanctions.<\/p>\n<h2>D\u00e9marches en ligne pour la DADS<\/h2>\n<p>La DADS doit \u00eatre transmise \u00e9lectroniquement via le portail officiel <a href=\"https:\/\/www.net-entreprises.fr\/\"><strong>www.net-entreprises.fr<\/strong><\/a>. Les employeurs doivent :<\/p>\n<ul data-spread=\"false\">\n<li>cr\u00e9er un compte ou se connecter \u00e0 leur espace personnel<\/li>\n<li>remplir le formulaire en ligne ou importer un fichier pr\u00e9par\u00e9<\/li>\n<li>valider et envoyer la d\u00e9claration avant la date limite du <strong>31 janvier 2025<\/strong>.<\/li>\n<\/ul>\n<p><strong>Attention :<\/strong> tout retard ou non-respect de cette obligation peut entra\u00eener une <strong>sanction financi\u00e8re<\/strong> de <strong>55 \u20ac par salari\u00e9<\/strong>, avec une limite de <strong>750 \u20ac par d\u00e9claration<\/strong>.<\/p>\n<h2>Conclusion<\/h2>\n<p data-pm-slice=\"1 1 []\">La DADS reste une formalit\u00e9 essentielle en 2025 pour les entreprises concern\u00e9es. En transmettant les informations relatives aux salari\u00e9s et \u00e0 leur r\u00e9mun\u00e9ration, elle assure le bon calcul des cotisations sociales et la protection des droits des travailleurs.
